Gift Funds for a California Down Payment: Rules, Limits, and How to Document Them Cleanly
Parents helping with the down payment, grandparents cutting a check, a spouse's family chipping in. Gift funds are common in Northern California and completely allowed, but the paperwork is more specific than most buyers expect. Here is exactly how to do it right.
In markets like the Bay Area, gift funds are less an exception and more the norm for first-time buyers. Lenders allow them, but every dollar has to be sourced and paper-trailed. Doing this cleanly at the start saves days at the end.
Who can gift
Conventional loans allow gifts from a relative, domestic partner, fiancé, or fiancée. FHA loans additionally allow gifts from a close friend with a clearly defined interest in the borrower. Employers and labor unions can also gift under specific programs.
The one non-negotiable rule: the money cannot come from anyone with a financial interest in the transaction. The seller, agent, builder, or lender cannot gift the down payment.
What the paperwork looks like
You need a signed gift letter stating the amount, the relationship, the date, and the language that no repayment is expected. You also need proof the donor had the funds and proof the funds actually moved. That usually means the donor's bank statement showing the withdrawal and your bank statement showing the deposit, matching amount and date.
The cleanest path is a wire directly from the donor's account to escrow at closing, which skips the borrower's account entirely.
How much can be gifted
For most conventional owner-occupied loans, the entire down payment and closing costs can come from gift funds. For a second home or investment property, some of the down payment must come from the borrower's own funds. FHA lets 100 percent be gifted for owner-occupied purchases.
There is no lender-imposed cap on the dollar amount of a gift, but the IRS annual exclusion is a separate consideration for the donor's tax filing. That is a conversation for the donor's CPA, not the lender.
